These Terms of Service (“Terms”) govern your use of kimwolldinc.com and purchases from KIMWOLLD INC, a Colorado corporation (“KIMWOLLD,” “we,” “us”). By using the Site or placing an order, you agree to these Terms.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order.
2. Products and descriptions
We work to describe products, colors, dimensions and specifications accurately. Colors may vary by screen, and minor variations in manufactured goods may occur. Product images may include styling items not included in the purchase.
3. Pricing and availability
Prices are in U.S. dollars and may change without notice. We reserve the right to correct pricing errors and to cancel orders affected by an obvious error, in which case any payment will be refunded in full. Products are subject to availability.
4. Orders
Your order is an offer to purchase. We accept it when we ship the products. We may limit or cancel quantities, including orders that appear to be placed by resellers without a wholesale agreement or that appear fraudulent.
5. Payment
You authorize us and our payment processors to charge your selected payment method for the order total, including applicable taxes and shipping.
6. Shipping, risk of loss and returns
Shipping is governed by our Shipping Policy and returns by our Returns & Refunds Policy. Title and risk of loss pass to you on delivery to the carrier, but we will help resolve lost or damaged shipments as described in those policies.
7. Product use and safety
Follow all assembly, weight-limit, electrical and safety instructions included with products. Outdoor and inflatable décor should be anchored as directed. Light-up products contain batteries; keep batteries away from children.
8. Warranty disclaimer
Except for any written limited warranty included with a product, and to the extent permitted by law, products and the Site are provided “as is” without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose. Some states do not allow these exclusions, so they may not apply to you.
9. Limitation of liability
To the fullest extent permitted by law, KIMWOLLD is not liable for indirect, incidental, special or consequential damages. Our total liability for any claim relating to a product will not exceed the amount you paid for that product.
10. Intellectual property
The Site content, including text, graphics, logos and images, belongs to KIMWOLLD or its licensors and may not be copied without permission. “KIMWOLLD” and the KIMWOLLD logo are brand names of KIMWOLLD INC.
11. Acceptable use
You agree not to misuse the Site, interfere with its operation, attempt unauthorized access, or post unlawful or misleading content, including fake reviews.
12. Reviews and submissions
If you submit a review, you confirm it reflects your honest experience with the product. We may moderate content for legality and relevance but do not remove reviews solely because they are negative.
13. Indemnification
You agree to indemnify KIMWOLLD against claims arising from your breach of these Terms or misuse of the Site.
14. Governing law and venue
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Any dispute shall be brought exclusively in the state or federal courts located in El Paso County, Colorado, and you consent to their jurisdiction. Nothing here limits rights you have under consumer protection laws of your state.
15. Changes
We may update these Terms by posting a revised version. Changes do not apply to orders placed before the update.
